He admits to them having a sexual relationship when he was 28 and she was 16, but calling out she was legal then in the eyes of Georgia is a red flag and a half to me. He’s either very aware of the legal age or magically started pursuing her when she was 16.

Why does any state have an age of consent that’s less than 18?

  3. Oh yeah, I'm not casting any doubt on what she's said or he admitted too, it's super gross. I'm just saying there's a lot of stuff going on between the additional context she's offered and his statement.

There are WAY more states where it’s 16 than 18 and most even have exceptions where they can be close in age (in some cases, younger than 16 if the other party is within a certain age gap). In the eyes of the law, for example, 19 and 14 is legal in Arkansas and 23 and 16 is legal in Florida.

UGH JULIAN. I know this is gonna sound dated but he's even my live journal avatar. I know this isn't about me but seeing neutral milk hotel in college is one of my favorite memories and I remember thinking how happy their energy was on stage and it was so contagious it just hurts my heart to know that's what was happening.

I know Brandon famously sold the entire T&N catalog to Capitol Christian in 2013 but beyond that no idea.

I remember an old interview with Jason Gleason after he left FSF and was promoting ActionReaction in which he referred to Brandon Ebel as “the devil”, and I do remember Brett being critical of Tooth & Nail years ago when TJT left the label as well. There was some bad blood between Brandon Rike of Dead Poetic and Brandon Ebel as well.

mxpx certainly had their issues as well. It makes sense given the history of bands not returning there for later releases

Tooth and Nail, along with a lot of other labels like Victory and Drive Thru most infamously, had predatory practices when signing bands. Pressuring these 18 year old kids into signing contracts assuring them it was cool and there was no need for a lawyer to look over it, etc. They were also know for sketchy accounting so they wouldn’t have to pay the bands. Brett talks about how their budget for Emotion is Dead was $10k and it went on to sell over 100k CDs, which they did not see any money from. That was par for the course for those labels unfortunately.

The big problem, where Tooth and Nail was especially shitty, is that the label would own all publishing rights, not just the masters. The bands had no control nor would see any money from licensing out songs (Top of the World in the Disney movie for example) and on top of that, they wouldn’t be able to re-record anything from their TN catalog. Stephen from Anberlin was on a podcast and said how when they re-recorded the Feel Good Drag, they had to get permission from Brandon and he went on to say that TN got all royalties from that song when it became a hit. Someone in a different video asked Brett if they’d ever re-record their TN albums and he explained the whole publishing thing so they couldn’t. Seems like Emery lucked out with that clause in their original contract haha.

Brett did say however that now their label practices are much more fair, per discussions he had with Aaron Marsh.

Thank you for listening to my TED Talk.

if that's the case re: Anberlin, i wonder how the royalties situation worked with those Livestream recordings, seeing as that they were released independently

I wonder if the TJT re-record of Into the Dark for the LOVE album had the same royalty implications as Feel Good Drag did for Anberlin? This has been a bummer of a week to hear these behind the scenes stories, quite frustrating to see people take advantage of innocent children under the guise of religion. It makes sense why it takes Tooth & Nail releases have been so oddly guarded/limited as far as reissues go.

Yeah, there was a podcast with the dude from Unoriginal Vinyl where he said it took 10 years to get licensing rights from Capitol for all the reissues.

iirc, a vinyl release of that first Showbread album was also held up by Capitol's rights issues. and others have asked about new pressings of the Help Yourself boxset and the guys in Anberlin have not only said "rights with Capitol are fucked", but "it took a miracle to get the old T&N, Republic, and new T&N (i.e. Lowborn) releases consolidated into one release, so it's probably not gonna happen again".

loved a few of their albums, but then learned their frontman reformed the project to make an entire album shitting on those who've gone through religious deconstruction (after having gone through it himself). sucks because he always seemed like a reasonable, tolerable person in the face of Evangelical bigotry, but just doubled down and basically said you're gonna burn in hell if your deconstruction journey doesn't bring you back to the Christian faith.

That was disappointing. I had a lot of respect for Josh as a writer, but he really toed the evangelical line in regards to deconstruction instead of looking for an honest discussion.

Hate that all of the T&N hype was just to line Brandon's pockets in the name of religion at the end of the day. They seemed to have such a good thing going, until the shady dealing caught up to them.
