Waiting until the last day to rule on Trump's immunity claims is one of the most blatant "the court is nakedly corrupt and beyond redemption" signals we have

they are just going to throw it back to the lower courts but have successfully wasted as much time as possible in order to cover Trump before the election

even the dudes that wrote it thought that, and Jefferson was famously extremist about it. They just didn’t expect our country to become so dumb about it.

The last 24 hours is a PERFECT example to do so but then again, it was written by rich guys for rich guys

Yyyep. Everyone on the right or left should just imagine Congress finally passes the law you want about the pet issue you care about the most, and then when the executive branch goes to enforce it, all the experts they have on that pet issue don’t actually get to decide how to implement it, instead some judge or justice who has never even thought about your pet issue beyond the surface level is going to decide what you actually meant to do about your pet issue in your law.

Yeah I think they envisioned there was going to be people like them who created a new type of government every few generations. I don't think they ever thought their specific interpretation of government for the late Enlightenment period would be enshrined forever and fetishized by weirdos in the far future.

Especially since the dude that wrote the constitution did hundreds of hours of reading and research and definitely did not think a senate that operated exactly like the Articles of Confed they were seeking to replace was a good way for a govt to run lol. They literally only agreed to it because it was the only way to get the small states to ratify, not because it was the best form of government

So does this mean the DEA can’t enforce the War on Drugs anymore?

Pretty silly to call women’s reproductive rights affecting “some Americans” but I can also see the point. Other cases like removing almost all wetlands and streams from federal regulation is also going to impact almost everyone too though. The amount of huge decisions can’t be downplayed.

No it just means 6 very conservative evangelical boomers get to solely decide how to interpret laws that criminalize drugs

yeah I wasn’t thrilled with the word choice there but a lot of people do see certain things as “won’t effect me” which I think in Chevron is near impossible?

    very fair point but

emphasizing the sheer breadth of how much this will effect so many different aspects of so many people's lives on a daily basis

Since the vast majority of laws that the country operates under are agency issued regulations I think that’s true.
To be clear though it doesn’t mean the agencies don’t have rulemaking power, it just means the courts don’t have to at all defer to the agency on the whether the regulation is a reasonable (to the judge) exercise under the statute the agency operates under. So for regulating air pollution for example, the Supreme Court or conservative judges can now decide if the costs of implementing air pollution equipment are reasonable to them. Environmental regulations are in big trouble, even more so than after the “‘major questions” debacle. But it’s also true for labor regs and medical regs and all regulations really
