    Nah I'm pretty confident that Roberts would have voted to stay the enactment of the law in that scenario. Not saying he would have eventually voted to strike down the law as unconstitutional, but he would have allowed it to not take effect at this time. He's a weird stickler for doing the bare minimum to maintain the court's "impartiality" and the fiasco over this decision happening this way is something he would've wanted to avoid.

    And I'll blame RBG all day for not retiring lol

    They stopped Garland from becoming a justice, I wouldn't be surprised if they would have tried the same if RBG retired. But I guess if she did it early enough, they couldn't say that BS about it being an election year.

    I was thinking more along the lines of finding all the laws and policies they've implemented that are known to increase abortion rates and going at them from that angle.

    Also the biggest issue for them with Garland was it would have been replacing a conservative with a liberal, which would have changed the balance of the Court. Not saying they would have let RBG's replacement slide through but it wouldn't have been as contentious. This is assuming she retired pre-2016 of course. During the election year all bets would've been off.

    I'd like to have more faith in the media but I'd also have to think that headlines like "Can A Resurgent Trump Defeat A Crisis Filled Biden Administration?" would produce more clicks than anything treating a 2024 run like the joke it would be (or just not really giving the attention that it doesn't deserve in the first place). And clicks are what matters after all

    Also, the reason to hammer the rbg thing years later is because that same scenario is playing out RIGHT NOW with Breyer.

    Seems pretty relevant if her failure to retire at an opportune time had adverse effects.

    also the thing with RBG and Feinstein is 87 year old women shouldn't be in positions of power where there deaths could fundamentally change democracy

    Fucking Feinstein. My gosh. There is literally a recall election RIGHT NOW that might cost the dems a chance to appoint her replacement and yet she still remains! It is like these people think they are immortal.

    What makes it worse is this lesson of hoping someone in their 80s keeps living to hold onto influence on power being a disaster has not been learned at all. Justice Breyer is refusing to retire, and kinda seems like before midterms is the only real chance the Democrats have at actually pushing a Supreme Court Justice through approval for the foreseeable future. I can only imagine the deranged court opinions that will come out if a justice of Alito’s ilk replaces Breyer and Roberts or Gorsuch become the “moderate” centrist justices.

    To be fair, I don't think Feinstein thinks she's immortal, I just am not sure she's aware she's even alive.

    RBG was in her mid/late 70s when Obama was able to appoint Sotomayor. Acting as if she had no reason to be aware of the issue until Obama’s second term is ridiculous - as if, from the POV of someone in 2008-2011, an Obama win in 2012 was at all a given. But hey John Paul Stevens was fucking 90 when he retired in 2010 and that turned out fine, so quit worrying!
