In 2018, the MN Legalize Marijuana party gained 5% of the vote in a statewide (AG) race, meaning they gained "major party" status. This year, a Legalize Marijuana congressional candidate running in a district with historically close 2-party races died just a month ago. A MN law states that if a "major party" candidate dies within like 2-3 months of an election, that election must be postponed. Multiple courts and eventually Neil Gorsuch rejected the postponement (Gorsuch had the power to deny hearing the case because it was an emergency request and I believe for such requests, the whole US map is split so that each SC justice has their own little jurisdiction where they have unilateral power to reject them rather than having to confer with the whole bench). Which, it's good for the Dem that this was rejected because a rescheduled election would obviously have a much lower turnout, but also I really don't understand what legal basis the courts used to justify going ahead with the election. Like to me it just ends up reading like they simply don't want to treat a third party as legitimate. And I'm struggling to find any court records of these cases where maybe the judges explained their rationale.
