software developer or software test or software test automation. I've done all 3 of those jobs here.

there's a ton of companies here, the problem is that there's also a ton of more qualified workers.

I don't know about severance honestly.

    thanks.

With you having made complaints against this boss youhave legal grounds for a wrongful termination if they cannot prove they fired you for a legitimate reason, you could claim it’s retalition. Which it pretty much is.

    Or am I wrong @KidLightning

Typically unless you're fired for something really bad – stealing, gross insubordination, etc. – you would still qualify for unemployment and it wouldn't hurt to try.

You could possibly make that claim, but it'd probably be a hard one to win. Especially if, as it seems, they are getting rid of others as well, so they could call it a staff reduction, and that they're targeting lower performing employees and cite that he's on an improvement plan, etc. (I'm not making any judgments about your work @littlejohn just off the top of my head these are the arguments I would make.)

In an at-will employment state, and especially a state like Texas, you're most likely going to get a court that would side with the employer over the employee. That's if you can even get to court. Chances are there's an arbitration agreement, and an arbitrator (who's most likely chosen and paid for by the company) is probably going to side with them.

But, typically, even in at-will employment states, employers establish policies and procedures for when and how they fire an employee to try and avoid claims of retaliation or discrimination. These can possibly be formally established (by something like an employee handbook or code of conduct) or by practice, e.g. this is how they treated everyone else so you should be treated the same. Again there are exceptions for gross misconduct, or something that's established in the same way as "zero tolerance".

In any case @littlejohn it seems like a new job, or at least a new manager, could be good for you. This place seems to be stressing you out and you should want an employer/manager who's trying to set you up for success, not failure.

these are all things that I've thought of.

I will file for unemployment for sure if it comes to that.

if I had known that this "improvement plan" was more like a "6 weeks of me not liking you then we'll fire you no matter how this goes" it would have been different.

yeah like I said I like the current project I'm on and it's managed by someone else who I get along with much better. that would be the best case scenario for me today. moving to his team and staying on his project.

There’s this lady at my work waiting for a specific co worker of mine. To entertain her toddler she pulled up YouTube on her phone. This kid has listened to the same version of ‘Pattycake Pattycake’ repeatedly for the last 20 minutes.

I used to keep Oreos in my bag for the sole purpose of quieting my toddler when we were at the store.

oooohhhh i've got a not so fun kid story today

so last night i was reading a comic on my ipad and i got a notification that somebody liked my comment on youtube. now, im an intellectual that doesn't leave youtube comments so i knew something weird was up. i pulled up my notifications and my daughter left a comment on a kids video that was totally innocuous coming from a 7 year old....but looked creepy as fuck coming from an adult man's account. so i spent the evening deleting a few other comments and unsubbing from the channels she decided to follow. ugh.

My son loves to tell people that I wear a helmet to work, which is really confusing for people who know where I work and what I do.

Now I Know This World Isn’t Spinning Just For Me Prestigious

I used to have to do volunteer work for high school. My volunteer of choice was announcing little league football games because my dad was president of the league and had coached my brothers and I when we were younger. My best friend at the time was cohost.

One Sunday during half time, I left the announcer box to grab some food from the concession stand. I forgot to lock the door. My best friend’s little brother was 5-7 (I forget) at the time, and he made his way into the box when I wasn’t in there. They also have an older brother (he was 24 at the time I think) we’ll call him George. He the proceeded to get on the speaker system and say random stuff. Thinking it was funny, my friend asked him through the window of the booth if he had a message for the fans. He says, and I quote:
“Safety is important. That’s what George said! That’s why Michelle was on top of him showing him how to stop someone from choking last night! George sounded like he was hurting”

My friend wasn’t allowed to cohost with me anymore. Idk why but this funny kid story thing reminded me of that
