Court Admits DNC and Debbie Wasserman Schulz Rigged Primaries Against Sanders

 

The writer of this either doesn't understand the law (likely) or is being purposely misleading. Either way, the court doesn't "admit" anything, it's *assuming* that the facts alleged in the complaint are true solely to see if the complaint could survive the motion to dismiss, which it could not for a number of reasons.

 

I have zero legal knowledge but I thought that wording sounded off. Why couldn't the complaint survive the motion to dismiss?

 

Lack of subject matter jurisdiction and standing. Basically, for the latter, they couldn't really make out a real injury they had suffered that could be directly traced to the DNC's actions and that the court could relieve. Just technical legal concepts essentially. Point is that the court is saying nothing about whether the primary was rigged (or not) as the case was not in that stage in the process.

I like that they put it under the category of Opinion to over their ass, but still run it as a straight news headline.
