    Just was thinknig that even if they could convince states/counties/etc to just ignore the votes of certain counties, I'd be hard pressed to believe even this SCOTUS wouldn't easily find 14th Amendment violations in that. Just choosing to treat some votes differently than others would be a huge equal protections issue I would imagine.

    One of the reason why the Bush v. Gore decision is what it is is because it was determined that certain county's voters were being treated differently than counties elsewhere in the state IIRC. One of the lawyers can chime in here but just based on the equal protection clause I'd have a hard time seeing the legal standing of just simply not counting an entire county's votes. Especially if that county is disproportionately minority. Roberts cares way too much about his legacy to ever let that happen, he'd twist the arm of anyone else on that bench that he'd need to to make sure there were 5 votes to not let that happen.

    It's a ridiculous argument from all sides but part of what some of these lawsuits have been alleging is that there have been equal protection violations already by virtue of the fact that some votes have been treated differently than others (as in, for example, counted despite the ballot being deficient in some way). If it got to the Supreme Court it would depend on which equal protection "violation" they want to believe in. And I think we all know how that would go.

    it was decided because five conservative judges wanted Bush to win

    Sure, Roberts might stand up and do the right thing. But the other five conservative justices???

    Yeah but even in that case, without a count or proof of which ballots were "cured", how else would they be able to discount those ballots other than to just...throw out all the ballots in the county? Even in Bush v. Gore that wasn't the ruling, it was just that the recount had to stop becuase it was "standardless" or whatever. We're not even getting recounts here, we're just getting "Hey throw out the votes of this county" lol.

    I think the reporting on the ACA decision shows that these judges discuss these things with each other. Roberts cares about his legacy, I think he'd make some pretty big threats to make it happen.

    The Bush V. Gore decision on the 14th Amendment violations for the recount was 7-2, believe it or not. 5-4 was that the recount couldn't continue with new methods and standards in place because it "couldn't be completed in time". Which was bullshit, of course.

    I think the argument from them thus far in the public filings has been something along the lines of the votes in County X have been given disproportionate special treatment compared to the votes in the rest of the state, and as a result the whole county's votes should be erased. Or, I guess in the last day or two, they've been saying the whole state should be nullified and the legislature should pick the electors instead. They're just trying to cause so much confusion and public backlash that the pressure forces the legislatures to do what Trump wants. At this point they aren't even counting on the courts to actually be the ones who decide.
