The album was a surprise release. We didn't know about Science Fiction until it dropped. All we knew about was Fifth Album.

The quote was, if I recall correctly, "If Brand New surprise releases an album this year, I will binge watch all of DBZ."

Now, "release" is in fact not synonymous with "announce". Of course the announcement came as a surprise, that is the nature of announcements, no one is arguing that. However, no date was given for the actual "release" of the album, the dropping of the album, if you will. Therefore, the fact that it came out in the fashion that it did, which I don't need to summarize here as we are all aware of it, was indeed a...surprise. Was it not? I rest my case.

@KidLightning Is found guilty of being a hack fraud and lying under oath. He is sentenced to watching all of DBZ, unedited!!! Court dismissed.

Haha, I'm on a computer at work, where they (thankfully) don't care about posting on sites like this. If I tried to watch TV at work . . . well, let's just say I wouldn't be at work much longer.

I'd definitely say it was a surprise release. It was stated to be in October with zero details and then dropped everything two days later

A digital contract was established! Handshakes are for verbal agreements. Those are hardly binding anyway. I know this because I recently watched The Founder. Ray Crock, did not honor his handshake agreement (idk how much of that is true, but it helps my point).

 

137 is the song Brand New wanted to write when it comes to a slow burning song with a crowd shaddering payoff. Kinda like You Stole, but it actually works live.

But, if we want to get technical (I am a lawyer after all) there was an offer, but no acceptance, therefore no agreement was made. (There was also no consideration, but I don't want to bore you with those details.)
