  1. I'm sure that part doesn't exactly bother them, but fwiw this is usually how it happens. This is just the extremist court's first real crack at it so everything is fucking huge and demoralizing.

  4. Bringing the cases to a court they could win them in was calculated, sure. For decades.
    But June is always end of session/big decision season, that's all I'm saying.

    Honestly, not sure how dems can even reconcile the "get out and vote" thing with this court. Anything they legislate, it seems like this court will find a way to strike down.

    Codify Roe into law? "Constitution doesn't explicitly give the federal government the right to legislation on abortion."
    Repeal the 2nd amendment? "No, you can't repeal an amendment from the bill of rights."
    Expand the court? "We know it happened in the past, but it was unconstitutional, we'll leave it at nine."

    I’ve been going back and forth on this the last few weeks, and part of me is all in on this strategy, but then the other part of me is thinking about how red states would then just ignore abortion laws, pollution laws, etc…and I’m not sure how to handle that. Federal troops going into states to make sure they’re checking the carbon output of a factory doesn’t seem plausible to me but maybe it is?

    At this point I don’t care how, just do something to make it look like you’re fighting. The rules clearly don’t matter anymore. Use what power you have and go all out.

    Of course there are dozens of extended factors, but 3 of 9 justices in a single term is the immediate, direct reason Roe was overturned.

    but like, if 2016 didn't happen, as long as dems refused to act on abortion protections it was only a matter of time until they got control of the courts and could gut everything

    if a storm knocks down your home, is it really the storm's fault? Or is it the fact that you spent 50 years refusing to do the upkeep necessary to protect your home if a big storm hit?

    Unless the court is expanded, any semblance of democracy left in this country is gone. Allowing partisan state governments to decide elections is the final straw. It's an absolute travesty.

    Disagree with this. The “major questions” doctrine that was just established would apply to those as well. This is like believing overruling Roe won’t threaten gay marriage or other substantive due process rights.

    The fact that the Constitution says nothing about the Supreme Court size should be all Democrats need to expand the Court. Call themselves Fundamentalist when it comes to the Supreme Court, its the same shit Republicans do with all their constitutional fundamentalist bullshit.

    they didn't have the votes. you're acting like the majorities they had from 2008-09 were all pro-choice and all they had to do was raise up the bill, when significant numbers of them were not. even if Roe had been codified, look at the rate with which this Court is ripping through settled law and established precedent. I agree with whoever said "you have to be lucky every time. we only have to be lucky once."

    the view that 2016 radically reshaped the trajectory of our country isn't a wild one, and the ability to lock in three justices in four years hasn't happened since Reagan... kind of a different political environment, wouldn't you say?

    what Dems need to do now is stand the fuck up to a branch of government that has too much power. unfortunately that primarily is going to need to come from the executive branch, with EOs while the Supreme Court is out of session. flood the goddamn zone.

    They didn’t even try, they very well might have been able to whip votes into place. The not even trying is what we’re consistently seeing. Even if they didn’t have enough votes, maybe the dem establishment shouldn’t have been backing pro life candidates over progressives, which, by the way, they’re still doing! It’s their own fault either way.
    Ultimately we’re on the same page about what they do now but I think you are failing to recognize any important nuance and really letting this party off the hook by just blaming the 2016 election.
    It’s also worth noting that trump never should have had 3 appointments. RBG should have been retired and replaced and there should have been way more of a fight to get Garland seated rather than just “putting it on the ballot” which we’re seeing all over again because they only have one playbook.

  25. It's so incredibly defeatist and politically silly to be like well they didn't have the votes and that's that. You can bully, cajole, negotiate, threaten your caucus. Imagine if LBJ was like well I don't have the votes. Just absolutely no concept of actually doing politics
