Which honestly is often incredibly useless in practice. 9/10 people just ignore what is being said straight to their face and stupidly talk to the cops anyway. And it is an incredibly rare case where a judge will actually side with the defense AND that victory actually changes the outcome of the case

Smoking is dumb and gross and should be banned, full stop.

If you've got a way to isolate yourself so that no one has to breathe or smell that shit, then maybe, but it should be outlawed in public or any shared spaces.

Plus smoking has been decidedly uncool for at least 15 years.

Banning does not necessitate criminalizing. Though I would not be opposed to penalties for those who produce/sell on a large scale, at least the disgorgement of any profits.

Also, smoking has been on a massive decline for a long time and that is even more pronounced in younger people (the smoking rate for 18-24 year olds is about half that of 25-64 year olds). At some point the barrier to entry will be too high for the perceived benefits.

 

Yeah, this makes absolutely no sense. It's not as if those historical regulations were always just there and developed along with the universe. They were created out of nothing at one point, so that should be analogue enough to create new regulations out of nothing. Or, ya know, out of empirical evidence.

This is also the exact opposite approach the Supreme Court took with Heller when it threw out the entire historical record of the 2nd amendment and its intention and interpretation to create, out of whole cloth, an essentially unfettered right for an individual to possess any gun at any time and at any place.
