    TMZ:

The baby from Nirvana’s famous “Nevermind” album art is all grown up … and now he’s suing the band for child sexual exploitation.

A man named Spencer Elden claims he’s the naked baby famously pictured in a swimming pool on Nirvana’s groundbreaking 1991 album cover … and he’s suing the band, its surviving members and Kurt Cobain’s estate, 30 years after the album dropped.

What changed? According to a GQ interview:

In the past you’ve said it was cool. When did that change?

Just a few months ago, when I was reaching out to Nirvana to see if they wanted to be part of my art show. I was getting referred to their managers and their lawyers. Why am I still on their cover if I’m not that big of a deal?

Why’d you reach out to them?

I was trying to do an art show with the photographer who took the picture. I was asking if they wanted to put a piece of art in the fucking thing.

He’s a probably wondering why Kurt just won’t respond to him after all these years.

    England.

So he’s basically said he was fine with it, until Nirvana didn’t want to contribute a piece of art for his exhibition and now he suddenly and conveniently feels sexually exploited?

“Why am I still on their cover if I’m not that big of a deal?”

this is a real quote hahahahhaha. Because bands always change the cover art of albums 20+ years old.

    Give what you can.

Well let's hope all future naked grunge babies learn from this and add a rev share piece to any future agreements.

I think it's worth mentioning that that pull quote is from 5 years ago, so not really the basis of the lawsuit. Still, this is clearly an attempt to siphon money from the cash cow.

This is interesting to me. There is actually a debate among some parent groups about the ethics of posting pictures of your kids to social media (eg, Instagram), because they can’t consent. And we’re just talking about normal pictures, like them at Disneyland or something. Being naked on the cover of Nirvana’s album very well could be traumatic for this guy, and this could add fuel to that side of the debate. Sure, it could be a money grab, but maybe it really has some aspect that should be taken seriously. From my own personal standpoint, I see it as an artistic baby picture and I would hope that this guy and everyone else can separate him as an adult man from this baby picture. It’s like two different people, and ridiculous to think “we’ve all seen him naked” as stated in the article. I can’t see myself being embarrassed about others seeing me naked as a baby. But then again, he really is alone in this particular boat, so I guess no one can really speak for him.

I have a feeling he’s going to regret this. He’s recreated the album cover multiple times over the years, and done interviews boasting about being on the cover. I may be wrong here but had he not come out publicly saying he’s the “Nirvana Baby” would people even really know it’s him? Either way this definitely seems like a desperate cash grab to me…
