It is absolutely a defense to the length of the ban. Some sort of consistency from the FA would be nice. If every similar incident is going to be a six game ban going forward, then fine. I doubt that will be the case.

Also, the reason that Torres incident didn't result in a ban is because it was seen by a linesman.

 

If it's not in the referee's report then it wasn't seen. No actual proof that the linesman saw it, Dembele's fat head might be obstructing his view for all we know.
