    Okay so we just had another massive storm blow through our area tonight and my worst fears came true now for a second time in two years. Yet another tree from the neighboring property fell on our house about an hour ago. Woke my wife and I up out of a dead sleep and we were both absolutely terrified. Kids are losing their minds.

    I’m fucking angry as hell. Little history here, the neighboring lot two years ago was a vacant lot and a complete mess of old trees and overgrowth. The tree that fell on our house at the time had been marked for removal for a year. After it fell, the company that owned that lot literally cleared it out about three weeks later, all except for two big, half dead trees, right at the property line just looming over our home. Those trees were also marked for removal at the same time the other one had been. They built a big two story house on the lot this year that they put up for rental and no one has moved in. For about a year and a half they had a port-a-potty sitting out front right at the corner of our lot. It was there until the neighbors complained because we were too emotionally exhausted by all of it to deal with it. Then they had a giant septic tank just hanging out in the side yard for a good six months. Then they parked a big trailer right at the end of our driveway, blocking our view so that it made backing out of the driveway nearly impossible and incredibly dangerous because we also live at the top of a hill so we can’t see who’s coming up the street too well as it is. With the trailer there for just as long as the port-a-potty it made trying to pull out of the driveway genuinely nerve wracking and we were nearly hit by speeding neighbors multiple times.

    So now one of those trees - again, long marked for removal - just fell on our house AGAIN. Any chance I have legal standing to sue? This is emotionally exhausting and I cannot believe we’re doing this all over again. Eerily enough this happened two years ago on July 24th and now it has happened two years later on August 24th.

    I would certainly be trying to sue. Or at the very least getting my homeowners insurance company to do so

    Given that the trees were marked in the states I’ve been in they would be liable for damages most likely. States often have laws about liability from trees, there could be local ordinances on it too. Worth talking to someone if you have significant damages. If they have insurance on the property it might just be a negotiation with their insurance company. Do you own the home? If so your home insurance company might have some answers and might want to get their money back.

    Thank you. I do own the home, which I am currently loving less and less for some strange reason, and I’ll be making some calls today wherein I attempt to maintain my composure.

    Will be interesting to see if this becomes the China party or the India party…or anything more than merely a discussion platform with zero obligations - no monetary or military contributions, no trade benefits, no requirements for participating or exiting. Whether it turns into anything will be worth a view, at least more than the current LinkedIn geopolitics it is now.

    If anything, I see this benefitting the Global South more than anyone else.

    Piggybacking off what others said, if your insurance company is covering it they would likely have a right of subrogation whereby they would be the ones with the right to sue and you would not be able to do so directly (or you risk your insurance company refusing to cover the claim).

    Separately, there may also be city, county, or state agencies you can report the company to, but the efficacy of that is questionable.
