    I can buy that schools may be as “safe” as grocery stores or maybe even a modicum safer.....but the measures you have to take to make it so basically drown teachers in a more stressful environment and I’d be hard pressed to believe that it actually raises academic achievement all that much.

    I've said before that schools can be safe to the point they probably can be open if every precaution necessary is taken -- access to frequent testing, contact tracing protocols, masks, socially distanced classrooms, etc. The problem is that a lot of schools don't have the resources to do everything necessary.

    In New Jersey, we have actually not seen many cases tied to schools. Since August there have been outbreaks in 88 schools for a total of 388 cases. Now I tend to believe the actual number is likely higher than that but still, when we are seeing about 5,000 cases per day in this state, schools are clearly not a significant source of spread.

    That is not to say schools should be open, especially now in the worst part of the pandemic so far with it continuing to get worse. But it is true in person learning is much better than remote in terms of both academically and socially and that children are much more likely to have asymptomatic or mild cases. THe main problem with that is certainly spreading it to teachers/staff or bringing it back to their household and infecting family.

    Again, not saying schools should be open, but I think it's a more debatable issue than simply just saying it's no safer than other indoor activities.

    Our school here ended up going back to full remote learning. They were running out of teachers because everyone was getting sick. I think they only had 2 kids actually test positive. The teachers were gathering socially and a bunch of them got sick.

    Standing has always been a frustrating doctrine bringing claims on behalf of people trying to protect the environment. It’s mostly made up and has been made more and more strict by conservatives like Scalia. But it is very funny watching Trump struggle with the concept right now.

    Standing is an important doctrine for a bunch of reasons, although of course invoking it the way GOP justices like Scalia have is bad.

    Not to get too nerdy but the “injury in fact” and “redressability” requirements have gone off the rails. What is a “case” or “controversy” has become way too strict. We lost a case in Ohio challenging an agency’s refusal to do a required rule making because we couldn’t prove the resulting rule would definitely clear up all the injuries. Which it’s like yeah we don’t even know what the rule would be exactly because they haven’t made it yet. So the court held our relief was too “speculative”. There is always months of expensive litigation just on these ridiculous standing requirements, never even getting to the merits. It’s mostly just another defense tactic that protects those who can afford to litigate it in my experience. It’s nice to see someone like Trump get burned by it though.

    Yeah the president is a figure head, they wouldn’t tell trump anything that actually mattered. If someone high in government has proof about aliens that information is not in his hands.
